Wi-LAN Releases Results of Legal Patent Review


Invitation Extended to All Interested Parties to License
Wi-LAN's Patents

Wi-LAN Inc. (TSE:WIN), a leading innovator in wireless data communications technology and products, announced the initial results of a legal review indicating that any implementation of the IEEE standard 802.11 (1999), as supplemented by 802.11a (1999), or any implementation of ETSI BRAN HiperLAN/2 infringes one or more claims under Wi-LAN's United States Patents No. 5,282,222 and 5,555,268 and Canadian patent no. 2,064,975. Wi-LAN is continuing to investigate other proposed standards and will declare its position once those proposals are definitive.

"We are pleased to announce that the legal review has verified what we always believed," said Dr. Hatim Zaghloul, chairman and CEO of Wi-LAN. "Going forward, we are now drawing a line in the snow regarding those who implement the 802.11a or HiperLAN/2 standards without a license. Patents are there to protect inventions and to reward the inventors who took early risk."

Wi-LAN will continue to offer its patent for licensing to all parties interested in implementing the IEEE802.11a or ETSI BRAN HiperLAN II. Wi-LAN is committed to license its patents on fair, reasonable and non-discriminatory terms. The company expects to license its technology to a variety of interested parties, including chipmakers and equipment manufacturers. Wi-LAN will continue to abide by the terms of its intellectual property letters filed with the IEEE and ETSI. The IEEE IP statement was filed on July 7, 1998 and the ETSI letter was filed on February 18, 1998.

Parties interested in developing products based on the IEEE802.11a or ETSI BRAN HiperLAN/2 can purchase semiconductor chips or modules from companies that license Wi-LAN's patent - such as Philips Semiconductors - or seek a license from Wi-LAN. On September 22, 1999, Wi-LAN and Philips Semiconductors announced the signing of a definitive licensing agreement whereby Philips gained exclusivity rights for a total of about two years for Wi-LAN's internal developments for semiconductor chips. This exclusivity did not affect Wi-LAN's ability to license its patents freely.

The Strength of W-OFDM Technology:
Conventional Orthogonal Frequency Division Multiplexing (OFDM) technology uses a number of frequency carriers to simultaneously transmit information, but the technology suffers from a number of technical limitations regarding amplifier linearity, resilience to multi-path and recovery of the carrier frequency.

Wideband Orthogonal Frequency Division Multiplexing (W-OFDM) technology was invented by Dr. Hatim Zaghloul and Dr. Michel Fattouche, co-founders of Wi-LAN under U.S. patent number 5,282,222 to enhance conventional OFDM. Wi-LAN introduced techniques to facilitate low cost, two-way broadband wireless communications using OFDM.

Wi-LAN's has developed considerable experience in working with OFDM technology and its prototypes since 1991. In 1993, the company began developing W-OFDM on available digital signal processor (DSP) platforms with the intent to develop a wireless local area network (LAN) product capable of connecting to a single computer or network of computers via an Ethernet cable. Wi-LAN has completed the development of products and systems based on DSPs and field programmable gate arrays.
